Regulatory Background

Part 6 of the Tobacco and Related Products Regulations 2016 (TRPR) places a legal obligation on manufacturers and importers of electronic cigarettes to notify the relevant competent authorities before products are marketed.

Regulation 31(3)(b) requires notifications to include a list of emissions produced during product use. Emissions testing must be carried out using a standardised puffing regime that reflects expected consumer use.
